These Terms and Conditions apply to reservations and stays at Alpensee Suites. The person making the reservation confirms that they are authorised to book for all members of the party, that the information supplied is complete and accurate, and that these Terms and the house rules will be made available to all guests included in the reservation.
Platform bookings: For reservations made through Airbnb, Booking.com or another booking platform, the payment, cancellation, refund and claims rules accepted on that platform take priority where they differ from these Terms.
1. Accommodation provider and property
Alpensee Suites is the accommodation name under which two privately operated holiday apartments are offered: Alpensee Suite 24C and Alpensee Suite 24D, both at Seestraße 3, 9542 Afritz am See, Austria.
The legally responsible accommodation provider and contracting party is identified in the booking confirmation and in the Legal Notice (Impressum) on the Alpensee Suites website. In these Terms, “Alpensee Suites”, “we”, “us” and “our” refer to that provider. “Booking guest” means the person who makes the reservation. “Guest” includes the booking guest and every person staying under that reservation.
2. Scope and order of precedence
These Terms apply to direct reservations, website reservations and reservations made through a booking platform or intermediary. The accommodation agreement consists of the confirmed reservation, the rate and cancellation conditions shown at booking, these Terms, the applicable house rules, any written individual agreement and, where relevant, the platform conditions.
A specifically agreed written condition takes priority over a general condition for the same subject. Mandatory Austrian and European consumer rights remain unaffected.
3. Booking and contract formation
A reservation becomes binding when it is accepted and confirmed by Alpensee Suites or by the booking platform used. A request, quotation or unfinished checkout does not create a confirmed reservation.
The booking guest must be at least 23 years old on the check-in date and must stay at the accommodation for the full duration of the reservation. The booking guest must provide accurate contact and guest information, pay all amounts due on time and ensure that every member of the party complies with the accommodation agreement and house rules. The booking guest remains the primary contact and is responsible for communications concerning the reservation.
4. Prices and included services
The price payable is the price confirmed for the reservation. Consumer prices include applicable Austrian VAT unless the booking confirmation clearly states otherwise. The confirmed price normally includes standard final cleaning, bed linen and towels. Tourist tax, the refundable security deposit and any clearly disclosed optional service are treated separately.
Prices may vary by dates, occupancy, length of stay, availability, booking channel, rate type and cancellation conditions. A later price reduction does not change an existing confirmed reservation. A requested change may be repriced at the rate available when the change is confirmed.
Obvious technical or pricing errors do not create a right to an unreasonable benefit. If a material error is discovered before the stay, the guest will be informed promptly and may accept the corrected reservation or receive a refund of amounts paid for the affected booking.
5. Guest registration and tourist tax
Austrian registration rules require complete and accurate details for every overnight guest. Registration is currently completed through Feratel or another officially accepted system. The booking guest must submit the required information within the deadline communicated before arrival and may not omit any person staying in the apartment.
For stays from 1 November 2026 onwards, the local tourist tax is EUR 4.50 per person per night for guests aged 17 and older. Statutory exemptions apply where the required conditions are met. If the competent authority changes the applicable rate or exemption rules, the rate legally applicable at the time of the stay will apply.
Tourist tax is separate from the accommodation price unless expressly included in the booking confirmation. It is calculated from the verified registration details and may be collected through a secure Stripe payment request. Deliberately incorrect or incomplete registration may lead to correction of the tax, delayed access and recovery of direct fines or losses where legally permitted.
6. Payment and pre-arrival requirements
Accommodation payments are handled according to the confirmed booking channel or direct booking confirmation. Alpensee Suites currently uses Stripe for the security deposit and tourist tax.
Before check-in, the guest must complete all mandatory steps communicated for the reservation, including full payment of any amount due, official guest registration, tourist tax and the refundable security deposit. Access instructions and the digital door code may be withheld until these requirements are complete. A delay caused by the guest not completing them does not entitle the guest to a refund and does not automatically cancel the reservation.
7. Refundable security deposit
A refundable security deposit of EUR 348 is required for each reservation unless the booking confirmation expressly states otherwise. It is separate from the accommodation price and is not a fee. The deposit must be paid before access is provided.
The deposit may be used, in whole or in part, for reasonable and documented costs for which the guest is legally responsible, including:
- damage to the apartment, furniture, fixtures, appliances, access equipment or storage room;
- missing items or a lost storage room key;
- extraordinary cleaning, specialist treatment or deodorisation caused by abnormal use, smoking or contamination;
- unauthorised guests, serious house rule violations or misuse of the accommodation that causes a direct financial loss; and
- other proven damage or loss caused intentionally, negligently or through improper use by the guest, the guest party or visitors for whom the booking guest is responsible.
Normal wear and tear is not damage. Any deduction will be explained and, where reasonably possible, supported by photographs, descriptions, invoices, repair quotations or other evidence. If the proven costs exceed EUR 348, the remaining amount may be claimed separately.
If no deduction is required, the deposit will be refunded in full within seven days after check-out. Processing time added by the guest’s bank, card issuer or payment provider is outside this seven-day period.
8. Cancellation and changes by the guest
For a reservation made through a booking platform, the cancellation and refund policy displayed and accepted on that platform applies. For a direct reservation, the policy shown in the booking confirmation applies. If no different direct-booking policy is shown, the following standard policy applies to stays of 27 nights or fewer:
- 24-hour booking grace period: if the reservation was confirmed at least seven days before check-in, cancellation within 24 hours after confirmation is free and the accommodation price is refunded in full;
- 30 days or more before check-in: cancellation is free and the accommodation price is refunded in full;
- 14 to 29 days before check-in: the cancellation fee is 50% of the accommodation price; and
- less than 14 days before check-in: the cancellation fee is 100% of the accommodation price.
Cancellation deadlines are calculated using the local time at the accommodation and the scheduled check-in time of 15:00. Tourist tax and the refundable security deposit are returned if they are not legally due. Platform service fees are handled by the relevant platform.
A non-refundable rate, a stay of 28 nights or more, or another special rate may have different conditions if these were clearly displayed and accepted before booking. A no-show, late arrival, voluntary early departure or interruption of the stay does not create an automatic right to a refund. Any amount that must be credited under mandatory law because the apartment is rebooked or costs are saved will be taken into account.
A request to change dates, apartment, occupancy, length of stay or rate conditions is subject to availability and is effective only after written confirmation from Alpensee Suites or the booking platform. The new price and conditions may differ from the original reservation.
9. No general 14-day withdrawal right
Accommodation booked for specific dates is excluded from the general 14-day withdrawal right for distance contracts under section 18(1)(10) of the Austrian Distance and Off-Premises Contracts Act (FAGG). A booking therefore cannot be cancelled free of charge merely because it was made online. The cancellation policy accepted at booking applies.
10. Changes or cancellation by Alpensee Suites
Alpensee Suites may change or cancel a reservation only where there is a serious and objectively justified reason, such as the accommodation becoming unsafe, legally unavailable or materially unusable because of fire, flooding, major technical failure, official restrictions or another event outside reasonable control.
The guest will be informed as soon as reasonably possible. If the booked accommodation cannot be provided, amounts paid for accommodation that is not provided, together with any unused tourist tax and security deposit, will be refunded. An alternative accommodation or changed reservation may be offered, but it will only replace the original booking if the guest agrees. Statutory rights that cannot be excluded remain unaffected.
11. Arrival, check-in and digital access
Standard check-in begins at 15:00 on the arrival date. Earlier access is possible only after express written confirmation. Alpensee Suites uses a smart lock. The individual access code is normally sent before arrival after all mandatory pre-arrival steps have been completed.
The access code is personal to the reservation and may be shared only with registered guests included in that reservation. It must not be published or forwarded to any other person. Guests must not manipulate, remove or obstruct the lock or keypad. Alpensee Suites may replace or deactivate a code where misuse or a genuine security risk is reasonably suspected.
If digital access fails, the guest must contact Alpensee Suites through the communication channel provided for the reservation so that a practical solution can be arranged.
12. Departure and check-out
Check-out must be completed no later than 10:00 on the departure date. The door code may expire automatically at that time. A late check-out is permitted only if confirmed in writing in advance.
Before departure, guests must leave the apartment in a reasonable condition and complete the departure steps communicated for the stay. These currently include:
- place used towels in the bathroom and start the dishwasher where appropriate;
- remove personal food from the refrigerator and dispose of waste in the designated outside containers;
- set the thermostat to 21 degrees Celsius;
- log out of personal accounts on the Smart TV;
- lock the storage room and return its key to the designated hook;
- close all windows; and
- lock the apartment door using the keypad.
Standard final cleaning does not cover excessive dirt, deliberate mess, severe stains, large amounts of waste or contamination requiring specialist treatment. Reasonable additional cleaning costs may be charged where the work materially exceeds normal holiday use.
13. Occupancy, visitors and permitted use
Each apartment may accommodate no more than six guests. Only persons included in the reservation and properly registered may stay overnight. The booking guest must notify Alpensee Suites before arrival of any change in occupancy. The legal and advertised maximum may never be exceeded.
Day visitors are permitted only with the booking guest’s supervision and only if they do not cause nuisance, create a security risk or result in unregistered overnight occupancy. Alpensee Suites may require a visitor to leave if these conditions are not met.
The apartment is for temporary private holiday accommodation. It may not be transferred, resold, sublet or used for unauthorised commercial activity, events, parties, photo or film production, illegal purposes or any activity inconsistent with normal residential holiday use.
14. House rules, quiet hours and smoking
Guests must respect neighbours, other residents, shared areas and the rules of the building and condominium owners’ association. Parties and events are not permitted. Quiet hours are from 23:00 to 06:00. At all other times, noise must remain reasonable.
Smoking and vaping are not permitted inside the apartment or in indoor shared areas. Any outdoor smoking must be lawful, safe and free from nuisance, and smoking materials must be fully extinguished and disposed of correctly.
Guests must not disable or interfere with smoke detectors, safety equipment, utilities, network equipment, heating controls beyond normal use, smart locks or technical installations. Locked private, owner or technical areas may not be entered.
15. Pets, minimum age and children
Pets are not permitted in Alpensee Suite 24C, Alpensee Suite 24D or any guest facilities provided by Alpensee Suites. Assistance animals are not treated as pets where applicable law requires their admission.
The booking guest must be at least 23 years old on the check-in date and must stay at the accommodation for the full duration of the reservation. Guests under 23 may stay only when accompanied throughout the stay by a parent, legal guardian or another responsible adult who is at least 23 years old.
Children are welcome but remain under the responsibility and supervision of their parent, guardian or accompanying adult at all times. Guests must assess the suitability of balconies, stairs, windows, kitchen equipment, surrounding terrain, the lake and local activities for the children in their care. Alpensee Suites does not provide childcare or supervision.
16. Care of the accommodation, damage and cleaning
Guests must use the apartment, furniture, appliances, fixtures, shared areas and storage facilities with reasonable care and in accordance with the instructions provided. Deliberate damage, negligent misuse and unsafe behaviour are prohibited.
Damage, breakage, missing items, spills, safety concerns or other incidents must be reported as soon as reasonably possible. Prompt reporting allows damage to be limited and repairs to be arranged. Guests must not attempt major repairs or alter technical installations without permission. Reporting an accidental minor breakage does not automatically mean that a charge will be made.
17. Problems, defects and right of access
A material cleanliness issue, defect, missing item or problem affecting the stay should be reported promptly after discovery. The guest must give Alpensee Suites a reasonable opportunity to inspect and, where practical, correct the issue. Reporting only after departure may limit the available evidence and the possibility of an immediate remedy, but does not remove mandatory consumer rights.
Guest privacy is respected. Access to the apartment may nevertheless be necessary for an emergency, suspected fire or water leak, urgent repair, immediate safety concern, prevention of serious damage, a legally required inspection or a reasonable suspicion of a serious breach of the accommodation agreement. Where circumstances permit, the guest will be informed before entry. Prior notice may not be possible in a genuine emergency.
18. Wi-Fi, equipment and streaming accounts
Wi-Fi, Smart TV functions and other equipment are provided as facilities for normal guest use. Alpensee Suites aims to keep them available and in working order, but cannot guarantee uninterrupted internet service, a particular speed or compatibility with every device or third-party service. A temporary fault in one facility does not automatically make the whole accommodation unusable.
Internet use must be lawful. Hacking, malware, fraud, harassment, copyright infringement and unlawful downloading or distribution are prohibited. Guests using personal streaming accounts are responsible for their own credentials and must log out before departure.
19. Parking, storage and personal belongings
Free parking is available as described in the booking and arrival information. One vehicle can normally be parked directly at the accommodation. A second vehicle must use the main parking area at the entrance of the park, subject to availability and current instructions. Vehicles may not block entrances, emergency routes, access roads or neighbouring spaces.
Where a storage room is provided, it must be locked after use and the key returned to its designated place before departure. Dangerous, illegal, flammable or prohibited materials may not be stored there.
Guests must take reasonable care of their belongings, lock the apartment when leaving and remove all personal property at check-out. Found items may be retained for a reasonable period where practical. Return postage, packaging, courier and handling costs may be charged. Perishable, unsafe, unhygienic or low-value items may be disposed of. Liability for guest property is determined by applicable Austrian law.
20. Privacy and exterior security camera
Personal data may be processed where necessary for reservation management, communication, payment processing, official guest registration, tourist tax administration, access management, security and compliance with legal obligations. Relevant service providers may include the booking platform, Guesty, Stripe, Feratel and Nuki or another access-management provider.
For property protection and entrance security, an exterior camera may monitor the entrance area. There are no cameras inside either apartment. Camera use and all other personal-data processing are governed by the Alpensee Suites Privacy Policy and applicable data-protection law.
21. Local conditions, activities and third-party services
Alpensee Suites is in an Alpine region. Weather, snow, ice, road access, lake conditions, ski areas, lifts, attractions and outdoor routes can change quickly. Guests must check current conditions, warnings, opening times, equipment requirements and their own ability before taking part in an activity.
Information about restaurants, transport, ski schools, attractions, equipment rental, wellness facilities, tours, the Erlebnis CARD and other local services is provided for convenience. Independent providers set their own prices, availability and conditions and remain responsible for their services. The unavailability or alteration of a third-party activity or guest benefit does not by itself change the accommodation agreement.
22. Serious breaches and termination of the stay
Where legally justified and proportionate, Alpensee Suites may require guests or visitors to leave and may deactivate access in response to a serious breach, including violence or threats, criminal activity, deliberate serious damage, dangerous conduct, repeated major disturbance, unauthorised parties, serious fire or safety violations, substantial over-occupancy, misuse of access systems or refusal to stop conduct creating an immediate risk to persons or property.
This measure will not be used for a minor or accidental issue. The financial consequences of a lawful termination are determined by the agreed cancellation conditions, the proven damage or loss and mandatory law.
23. Liability
Each party is liable in accordance with applicable Austrian law. The booking guest is responsible, to the extent provided by law, for damage and loss caused by the booking guest, members of the party, children under their supervision and visitors for whom they are responsible.
Alpensee Suites remains responsible for its contractual and statutory obligations and for acts or omissions legally attributable to it. Nothing in these Terms excludes or limits liability, remedies or consumer rights where exclusion or limitation is prohibited by law, including liability for intentional conduct, gross negligence or personal injury where applicable. Independent third-party providers remain responsible for their own services.
24. Applicable law and disputes
The accommodation agreement is governed by Austrian law. This choice does not deprive a consumer of mandatory protection available under the law that would otherwise apply to that consumer. Any dispute will be heard by the court competent under mandatory law. Before formal proceedings, the parties are encouraged to give each other a reasonable opportunity to resolve the matter directly.
25. Final provisions and contact
The version of these Terms made available or accepted when the reservation is concluded applies to that reservation. Website updates apply only to future reservations unless a later change is expressly and validly agreed. If one provision is invalid or unenforceable, the remaining provisions continue to apply to the extent legally possible. A failure to enforce a provision once does not permanently waive it.
For an existing reservation, the preferred contact method is the messaging channel used for the booking. The legally responsible provider, electronic contact address and other mandatory legal details are published in the website Legal Notice (Impressum).
Booking confirmation: By completing a reservation, the booking guest confirms that these Terms were available before the agreement was concluded and accepts responsibility for making the applicable accommodation rules available to every member of the party.
